Any site conducting illegal activities and / or copyright infringements.   Violations and attempted violations of system & network security. Or any type of tampering with the system with the purpose to inflict harm.   Peer to Peer / Portal and upload and download type sites related to hacking and warez.   Specific Violations of This AUP (not an exclusive list): Advance Fee Fraud, Child Porn Site, Child Porn Email, Copyright Infringement, Cracking, Forgery, Fraud Site, Hacking, HYIP Site, ID Theft, Infection, Invalid Hostname, Open Relay, Pharmaceuticals, Phishing, Proxies, Proxy Hijack, ROKSO, SORBS, Spam, Terrorist Site, Wares.

Payment is Due on or before Due Date. A fee of $5.00 will be Imposed to any account that does not pay their Invoice on TIME. AND or your Account will be SUSPENDED

Account Setup & Email on file

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is YOUR responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you. The primary email address on file will be used to do so. It is YOUR responsibility to ensure the email address on file is current or up to date at all times.

Cancellation and Refunds

We reserve the right to cancel an account at any time. We do not offer refunds for breech of our terms of service.

Customers may cancel at any time. We give you an unconditional 10-day money back guarantee on managed shared hosting, and reseller solution's. You may cancel your account within 10 days of opening the account for a full refund, excluding add-ons, overages, domain names, etc. for a full refund, if your account was not suspended due to breaking any of our policies. After 10 days, you may cancel at anytime with a 5 day notice.

Refund requests after 10-days will be refunded on a prorated basis of any unused time, with the EXCEPTION of those plans purchased at "Auction" - i.e. discounted Ebay purchases - or sale purchases, where the sale price represents a value greater than forty percent (40%) of Carolina Blue Web Hosting's 'standard' plan fees!

For example, if you prepaid one (1) year to save money, but for some reason need to cancel your service early, then your contract will revert to a month-to-month contract and we will refund the difference between that of the one (1) year prepay rate and the adjusted rate had you signed up for a month to month service from the beginning. Any partial month will not be refundable.

Canceling your PayPal or 2CheckOut subscription may result in immediate cancellation of your hosting account regardless of any remaining time left that you have pre-paid for. Be sure that you have copies of your web files before you cancel your hosting. Please see our Acceptable Use Policy / TOS for further information.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund and/or if you have opened a second account with us.

Free Months of Service & Promotions

From time to time, Carolina Blue Web Hosting offers value added and promotions geared to expanding its client base, while rewarding our client's loyalty, With these offers come provisions for the distribution and/or acceptance by the client.

As relative to that of 'Free Months of Service', Carolina Blue Web Hosting will issue said free services to that of 'NEW' of new accounts ONLY, Said services will be applied within these guidelines as follows:

• Annual Prepaid Clients - any and all Free Months of Service will be extended and issued to that of the end of the initial term of the service period.


• Month to Month Clients - any and all Free Months of Service will be applied to each client's account in an associative "one on, one off" manner, AFTER the second month of service has been paid in full. For example, if a client is to receive two (2) free months of service, the first (1st) month of free service will be applied and issued to the client's account in month three (3), after the second (2nd) months fees have been paid in full, and the second (2nd) month of free service will be applied and issued to the client's account in month five (5), after the fourth (4th) months fees have been paid in full.

Unlimited / Unmetered Hosting Packages

When we say unlimited domains, unlimited disk space and bandwidth, of course there are terms & conditions that you must adhere to. This means unlimited webpages, domains and web graphics, not downloads or streaming media. Our servers are shared hosting servers and memory and CPU usage is not unlimited. CPU intensive files are not permitted on our servers and accounts may not to be used to host a collection of mp3s, audios, videos, anime, .rar files, Warez, gamers sites, shout cast and similar, or to backup your computer or another source. They may not be used for general storage of any type. They may not be used as download mirrors or download/upload portals. While the sale of eBooks and other legal small download files are permitted within reason (see download files below) with the unlimited package, hosting and storage of mass quantities where our servers are used as a distribution point is not permitted.

They may not be used for HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes. They may not be used to provide proxy servers. All content stored on a reseller account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only. This means that all content stored on an unlimited account must be used for "acceptable" website use. “Unacceptable” usage is anything that a shared server would not be able to provide under standard circumstances and uses a high percentage of CPU or Memory (10%+) usage. Free hosting is not permitted with any of our packages.

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality: In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.

Undesirable Content: Certain types of content are not permitted on our network. We do not host pornographic content of any description, unless your plan comes with this feature, or you selected adult content as an option.. We reserve the right to determine what constitutes pornographic content and what does not (see adult sites below). Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. The sale of resalable eBooks is ok.

Bulk Email: The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden. As a guideline, we consider sending over 200 emails at once as bulk email.

Misuse Of Resources: Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media, audio, video and shout cast can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.

Password Protected Directories: Using password protected directories to conduct illegal activities is strictly prohibited. Sites that use password protected directories where their use is not clear are subject to suspension while we investigate the legality of the hidden content.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.

This Acceptable Use Policy must be followed by all end users and resellers.

Download Files

Collections of download files are not permitted on shared servers because they slow the server down. A reasonable amount of download files can be permitted if you keep the file size under 2000 k.
